STANDARD TERMS AND CONDITIONS OF SALE
Terms of Sales
1. Waterville Woodcraft undertakes, upon acceptance of an order, to sell, produce and deliver to the customer the products ordered by the latter.
2. The products presented on the site are normally available for sale. If, for any reason, a product cannot be delivered to the customer, the sums paid will be refunded in full, without the customer being able to claim any compensation.
Obligations of the buyer
3. In addition to payment for the order, the buyer undertakes to provide Waterville Woodcraft with all the information necessary for the delivery, and in particular an address to which the delivery can be made during business hours.
Payment
4. Orders are payable before manufacturing, unless a term agreement is established and indicated on the invoice or order.
5. In the event of non-payment on the due date, Waterville Woodcraft reserves the right to request payment at a fixed interest amounting to 24% per year of the amount remaining due.
6. Waterville Woodcraft reserves the right to suspend any delivery and production in progress without warning in the event of late payment or exceeding the granted credit limit.
7. If a payment is still unpaid more than sixty (60) days after the due date, Waterville Woodcraft reserves the right to use the services of a debt recovery company. All legal costs will be the responsibility of the client.
Price (excluding transport)
8. An invoice is produced for each order.
9. The price of the items in the order confirmation is the final price. If there is an error, do not hesitate to contact us.
Transportation
10. Unless otherwise agreed, shipping costs are always the responsibility of the customer. An estimate of the transport cost will be added to the order if required by the customer. The cost may be adjusted in the event of a price difference between the estimate and the carrier's actual cost.
11. Unless there is a special agreement, the goods always travel at the risk of the recipient.
12. The choice of delivery method is made according to the price, availability or reliability of available carriers or according to the customer's preference.
13. Waterville Woodcraft undertakes to do its best to ensure that the goods are shipped and delivered on time. The transport time remains the responsibility of the carrier.
Property
14. The items delivered remain the property of Waterville Woodcraft until full payment has been made.
Retraction
15. Because the products are made to measure, the customer automatically waives the right to withdraw the order.
Return - Terms and conditions
16. If there is a quality defect or manufacturing error, Waterville Woodcraft is responsible for the repair or replacement to the same specifications as the initial order. Return costs will also be covered by Waterville Woodcraft. If the error is the responsibility of the customer, the costs will be assumed by the customer.
Guarantee - exclusion
17. Defects and deteriorations caused by natural wear or by an external accident (disassembly, incorrect assembly, defective maintenance, abnormal use) or by a modification of the product, not planned or specified by the seller, are excluded from the guarantee.
Major Force
18. Neither Waterville Woodcraft nor the customer can be held responsible for any non-performance of the contract originating from but not limited to a major force such as: war, strike, earthquake, pandemic, etc.
Applicable law
19. The parties agree that this contract is subject to Quebec law and established in French, and that it will prevail over any translation that may be made.
Attribution of competence
20. In the event of a possible dispute over the interpretation or execution of these conditions and after the failure of any attempt to find an amicable solution, any claim or request must be filed before the Quebec judicial courts, and this, in the judicial district of Saint-François.
